By submitting an Entry (including any uploaded photo), entrants grant the Promoter a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish, display, edit (including cropping/resizing), and communicate that content for the purposes of the Promotion and promoting Love Food Hate Waste New Zealand, including:
(a) displaying photos on the Leftover Legends Map; and
(b) using photos in promotional activity with reference to the entrant’s first name and location (region and town/city).
8.1A The licence in clause 8.1 continues for five (5) years from the end of the Promotion Period for promotional purposes. The Promoter may retain copies of Entries/UGC for record-keeping, legal compliance, reporting, and audit purposes.
8.1B The Promoter may allow its contractors, agents, and service providers to use the UGC strictly to support operation, administration, moderation, and promotion of the Promotion and Love Food Hate Waste New Zealand.
8.2 Entrants confirm they have the right to grant this licence.
8.3 Moral rights: To the maximum extent permitted by New Zealand law, entrants consent to the Promoter using the content without identifying the entrant beyond first name and location, and without needing further approval for edits made for formatting or promotional purposes. (Nothing in this clause limits any non-excludable rights under New Zealand law.)
8.4 Removal requests: An entrant may request removal of their photo from the Map or cessation of future promotional use by contacting the Promoter. The Promoter will use reasonable efforts to comply within a reasonable time, but cannot guarantee removal from materials already published, printed, distributed, or shared by third parties.
8.5 Indemnity: The entrant is responsible for their UGC and agrees to indemnify the Promoter (and its officers, employees, contractors, and agents) for any loss or claim arising from a breach of clauses 7 or 8 by the entrant, except to the extent caused by the Promoter’s negligence or breach of law.

9. Prize

9.1 There is one (1) prize winner.
9.2 The prize is “free groceries for a year”, being 52 x NZD $250.00 Woolworths New Zealand grocery e-gift cards (E-Gift Cards), total prize value NZD $13,000.

9.2A The E-Gift Cards provided as prize are “Simply Grocery Cards”; they are redeemable in-store only at Woolworths supermarkets; they cannot be used for online purchases.  They cannot be used to purchase liquor or tobacco, other Woolworths gift card types, or other excluded items.  Woolworths gift cards terms and conditions and exclusions apply. They are available at www.woolworths.co.nz/info/terms-and-conditions/countdown-gift-card.
9.2B Prize Sponsor: The prize is sponsored by Woolworths New Zealand Limited.
9.2C For clarity, “free groceries for a year” is a promotional description only. The prize is limited to the E-Gift Cards described in clause 9.2 and does not guarantee the winner’s actual grocery costs for any period. The weekly E-Gift Card value was selected for promotional purposes.
9.2D The stated prize value is in New Zealand dollars and is correct as at the start of the Promotion Period.
9.3 The Promoter will provide the E-Gift Cards all at once to the winner via email (to the email address used to enter, unless otherwise agreed).
9.3A The winner is responsible for ensuring they can receive emails at the nominated email address (including checking junk/spam folders). If delivery fails due to an incorrect or inaccessible email address provided by the winner, neither the Promoter nor the Prize Sponsor will be responsible.
9.4 The prize is not redeemable for cash, is not transferable, and must not be re-sold or exchanged. The prize is subject to the applicable Woolworths gift card issuer terms and conditions (including any conditions relating to redemption, use, and expiry/no-expiry).
9.4 A Lost or stolen E-Gift Cards: E-Gift Cards should be treated like cash. To the maximum extent permitted by law, neither the Promoter nor the Prize Sponsor is responsible for E-Gift Cards once delivered to the winner’s nominated email address, including if E-Gift Cards are lost, deleted, stolen, misused, or accessed by an unauthorised person.
9.5 The Promoter is not responsible for any restrictions imposed by Woolworths New Zealand in relation to gift card use, expiry, or acceptance.

10. Draw and Winner Notification

10.1 The winner will be selected by random electronic draw from all eligible entries received during the Promotion Period.
10.2 The draw will take place at 10:00am NZDT on 1 April 2026.
10.2A The draw will be conducted at the Promoter’s office (or another location in New Zealand determined by the Promoter) using a random selection method.
10.3 The winner will be notified by email.
10.4 The winner must respond within ten (10) Working Days of notification.
10.5 The winner must provide proof of address in New Zealand (and any other information reasonably required to confirm eligibility) before the prize is awarded.
10.6 If the winner does not respond within the timeframe, cannot be contacted, fails verification, or is otherwise ineligible, the Promoter may void the winner’s entry and conduct a redraw on the same terms.
10.7 Any redraw will occur within 10 Working Days after the original winner is voided, and the new winner will be notified in accordance with this clause 10.

11. Publication of Winner

11.1 The Promoter may publish the winner’s first name and region on the Promoter’s website, social media channels, and subscriber newsletter.
11.2 The Promoter may, in its reasonable discretion, withhold publication where required by law or where publication may create a safety or security risk.

12.1 By entering, entrants consent to the Promoter collecting and using their personal information for the purposes of administering the Promotion (including processing Entries, sending entry confirmations and Promotion-related messages, contacting the winner, prize fulfilment and verification) and operating the Leftover Legends Map.

12.1A The Promoter will collect personal information directly from entrants via the entry form. Providing an email address is required to enter and administer the Promotion (including contacting the winner). Location details (region and town/city) are required to operate the Map. Photo upload and workplace selection are optional.

12.1B The Leftover Legends Map will be operated by the Promoter and publicly viewable on the Promoter’s website. It will display an entrant’s first name, region and town/city and (if uploaded and approved in accordance with clause 7.2), the entrant’s photo.

12.1C The Promoter may use service providers (for example, website hosting, moderation, analytics, and email delivery providers) to administer the Promotion and operate the Map, and those providers may process personal information on the Promoter’s behalf for those purposes.

12.2 Monthly tips (optional): If an entrant opts in on the entry form, they will be added as a Love Food Hate Waste NZ subscriber and will receive monthly emails with tips and resources to help reduce food waste. Entrants can unsubscribe at any time using the unsubscribe function in each email

12.3 The Promoter will not sell entrants’ personal information and will not share entrants’ personal information with third parties for their own marketing purposes unrelated to this Promotion or Love Food Hate Waste New Zealand.

12.3A The Promoter may share the winner’s details with the prize sponsor solely to the extent reasonably necessary to facilitate prize fulfilment and verification.

12.4 Entrants have rights to request access to and correction of their personal information. Requests can be made by contacting the Promoter using the details in clause 1.2.

12.5 Unsubscribe processing: Unsubscribe requests will be processed within the timeframe required by applicable law.

12.6 Retention: The Promoter will retain personal information only for as long as reasonably necessary for the purposes described in these Terms and any legal or reporting requirements, and will then securely delete or de-identify it. Without limiting the above, the Promoter generally expects to retain:
(a) Entries and entrant contact details for up to twelve (12) months after prize fulfilment to administer the Promotion and respond to queries or complaints;
(b) winner verification and prize fulfilment records for as long as required by law (for example, for financial record-keeping or audit purposes); and
(c) UGC that is selected for promotional use for up to five (5) years from the end of the Promotion Period (see clause 8), unless removed earlier following a request under clause 8.4. Monthly tips opt-in details (if provided) will be retained until the entrant unsubscribes or the Promoter no longer uses that mailing list.

13. Food Safety Disclaimer

13.1 The Promotion encourages enjoying leftovers, but food safety is the entrant’s responsibility. Entrants should follow safe food handling and storage practices and should not consume food that may be unsafe.
13.2 To the maximum extent permitted by law, neither the Promoter nor the Prize Sponsor is liable for any illness, injury, loss, or damage arising from the preparation, storage, reheating, or consumption of leftovers.

14. General Conditions, Disqualification, and Liability

14.1 The Promoter may disqualify any entrant who:
(a) breaches these Terms;
(b) tampers with the entry process;
(c) submits false, misleading, or deceptive information; or
(d) acts in a way the Promoter reasonably considers to be improper, fraudulent, or undermining the fair operation of the Promotion.
14.1A Entries that are incomplete, illegible, corrupted, or not submitted in accordance with these Terms may be deemed invalid.
14.2 To the maximum extent permitted by law, neither the Promoter nor the Prize Sponsor is liable for any loss, damage, or injury (including indirect or consequential loss) suffered or sustained in connection with the Promotion or the prize, except where liability cannot be excluded under New Zealand law (including under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 where applicable).
14.3 The Promoter is not responsible for entries not received due to technical issues, network congestion, website outages, or any other reason outside the Promoter’s reasonable control.
14.4 If the Promotion cannot run as planned due to events beyond the Promoter’s reasonable control (including fraud, technical failures, or administrative error), the Promoter may suspend or cancel the Promotion. If the Promotion is suspended or cancelled, the Promoter may (to the extent permitted by law) conduct the draw from all eligible Entries received up to the time of suspension/cancellation.
14.5 Complaints and queries: Any questions or complaints about the Promotion may be directed to the Promoter using the contact details in clause 1.2. Complaints should be made as soon as reasonably practicable (and, where possible, within thirty (30) days after the winner is notified). The Promoter will use reasonable efforts to respond within ten (10) Working Days. The Promoter’s decisions relating to the conduct of the Promotion (including eligibility and the validity of Entries) are final, subject to applicable law.

15. Governing Law

15.1 These Terms are governed by the laws of New Zealand, and entrants submit to the non-exclusive jurisdiction of the New Zealand courts.
